Truth Legal’s Andrew Gray represented a cyclist who was injured whilst cycling at top speed during a race in the countryside. What caused this excellent cyclist to sustain multiple soft tissue injuries injury was a defective cattle-grid. Cattle-grids can be particularly dangerous to any two-wheeled mode of transport.
The dangerous, defective cattle-grid caused the cyclist to be catapulted off the bike at speed. The cattle-grid was part of the highway, maintained at the public expense. Accidents happen – of course – but the cyclist had no choice but to cross the dangerous cattle-grid.
Andrew Gray visited the cattle-grid, taking measurements of the gaping gap which was the cause of the accident. On inspection, it was clear that the cattle-grid had not been maintained for some years. The council had failed to maintain the cattle-grid, which had become a potential death-trap.
Under a No Win, No Fee agreement, at no cost to the cyclist, Truth Legal successfully pursued the local council. Court proceedings were required, but the council settled out of court for not an insignificant sum. The cyclist said: “Really glad I came to you as it’s been first class right from the beginning.”
