The law requires that, when a consumer is dealing with a business, goods and services supplied must be of a certain standard.
Goods supplied must be of satisfactory quality and fit for purpose, they must match their description and any sample seen and the party who supplies them must be entitled to do so. The terms of an agreement between the parties relating to those goods must not be unfair and where the goods are subject to a finance agreement regulated by the Consumer Credit Act 1974 there are strict obligations to which a creditor must adhere, for example licensing requirements, practices and procedures to be followed and specific documents which must be provided.
Services supplied must be carried out with reasonable care and skill and where the contract doesn’t stipulate otherwise carried out within a reasonable time and for a reasonable charge.
If a supplier of goods or services has not complied with their legal obligations then you may have a claim against it, and you may be entitled to a refund, repair or rejection of any goods and money for any other losses which you have incurred.
If you have experienced an issue with a business that has supplied goods or services to you and you been unable to resolve this through any internal complaints procedure, if the business has one, you may need to take further action.
Our specialist consumer law solicitor has 10 years’ experience in dealing with consumer disputes and can advise you on whether you have a potential claim, the possible outcome of that claim and options as to how the dispute can be dealt with. A court claim is not the only way to resolve a consumer dispute, it may be possible to negotiate settlement, mediate or refer the matter to an ombudsman, all of which can take place without issuing a claim.
